Divorce
It is an unfortunate fact of life that not all marriages are
successful. When a relationship breaks down it is not unusual for one or both
parties to take legal advice with a view to regulating the financial aspects of
separation and ultimately divorce.
If there are children of the marriage under 16, it may be necessary to use the
law to resolve disputes over residence and contact, formerly known as custody
and access.
When both parties are satisfied that the marriage is over, it is normal to try
to achieve a fair division of the family assets including the matrimonial home.
In the majority of cases this is achieved by negotiation between solicitors and
agreement between the parties. We emphasise negotiation and agreement rather
than conflict and confrontation in the application of the principals of
matrimonial law to the special circumstances of each individual case.
We can also advise you on family protection, domestic violence, interdicts,
adoption, and child care proceedings.
We can make Legal Aid available in suitable cases. We are prepared to give a half
hour initial interview in matrimonial cases free of charge to provide basic
advice and ascertain whether legal input is required.
